PARTICIPATION WAIVER.

1. Who this waiver applies to

This waiver applies to every participant attending a NINEBASE in-person coaching session, G9 Club in-person block, camp, clinic or trial, held anywhere in New South Wales, Australia. Participants under 18 must have this waiver read and accepted by a parent or legal guardian before attending.

2. Risk warning under the Australian Consumer Law

Rugby coaching is a recreational service involving physical exertion, contact with the ground, equipment and other participants, and skill activities performed at speed. Participation carries an inherent risk of injury including sprains, strains, fractures, concussion, dental and facial injury, heat illness and, in rare cases, serious or permanent injury. This is a risk warning for the purposes of the Australian Consumer Law and equivalent NSW legislation.

3. Assumption of risk

The participant (and, where applicable, the parent or guardian) acknowledges these risks, accepts responsibility for the participant's own safety, and confirms that participation is voluntary.

4. Fitness and medical declaration

You confirm the participant is medically fit to take part, is not currently recovering from a concussion or an injury that would make participation unsafe, and that all relevant medical conditions, allergies and medications have been disclosed to NINEBASE in writing before the session.

5. Concussion protocol

NINEBASE follows Rugby Australia concussion guidance. Any participant suspected of concussion will be removed from the session immediately and must not return to training or play without written medical clearance and completion of the graduated return-to-play protocol.

6. Emergency treatment consent

You authorise NINEBASE coaching staff to arrange first aid, ambulance transport or emergency medical treatment if required, and you accept responsibility for any related costs not covered by Medicare or private insurance.

7. Insurance

NINEBASE holds public liability insurance for its coaching operations. NINEBASE does not provide personal accident, income protection or medical insurance for participants. Participants are strongly encouraged to hold their own cover, including through their club or school registration.

8. Release and indemnity

To the maximum extent permitted by law, and without excluding, restricting or modifying any non-excludable consumer guarantee, the participant releases NINEBASE, Harrison Goddard, its coaches, contractors and venue partners from liability for loss, damage or injury arising from participation, other than loss caused by their reckless conduct, and indemnifies them against claims arising from the participant's own breach of these terms or unsafe conduct.

9. Conduct and safety directions

Participants must follow all coach directions, venue rules and safe-play instructions. NINEBASE may remove any participant whose behaviour puts themselves or others at risk, without refund.

10. Child safety

NINEBASE coaches working with minors hold a current NSW Working With Children Check. NINEBASE maintains a child safe policy: no one-to-one unsupervised contact, no private messaging with minors, and all concerns reported through the safeguarding contact below.

11. Photography and footage

Sessions may be recorded for coaching analysis and, with separate consent, for promotional use. You may withdraw promotional consent at any time by emailing hello@ninebase.au. Analysis footage is stored securely and shared only with the participant (and guardian, where a minor).

12. Governing law

This waiver is governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of its courts.
