TERMS & CONDITIONS.

1. About NINEBASE

NINEBASE is a rugby coaching platform owned and operated by Harrison Goddard, based in Sydney, New South Wales, Australia. These Terms & Conditions govern all use of the NINEBASE website, member area, digital products, in-person coaching sessions, and any related services (together, the 'Services'). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility & Parental Consent

The Services are intended for rugby players aged 12 and over. Players under 18 must have a parent or legal guardian read, accept and sign up on their behalf. The parent or guardian remains responsible for supervising the minor's use of the Services, attendance at in-person sessions, and compliance with these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and current information. NINEBASE may suspend or terminate any account that breaches these Terms, at its sole discretion, without refund where the breach is material.

4. Memberships, Programs & Purchases

Memberships (including the G9 Club) are billed on a recurring monthly basis in Australian Dollars (AUD) and continue until cancelled by you inside your account. One-off purchases (such as the 9 Fundamentals ebook or individual Programs) grant a personal, non-transferable licence to access the relevant content. All prices are inclusive of GST where applicable.

5. Refund Policy

Due to the digital and immediately-accessible nature of the Services, all sales are final. Monthly memberships can be cancelled at any time and will not renew for the following month, but partial-month refunds are not provided. One-off digital products are non-refundable once access has been granted. This policy does not limit any non-excludable rights you have under the Australian Consumer Law.

6. In-Person Coaching Sessions (Sydney)

In-person coaching sessions are held at approved training venues in the greater Sydney area. Session times, locations and coaches are subject to change based on weather, venue availability and Harrison's professional playing commitments. Missed sessions are non-refundable but reasonable efforts will be made to reschedule where 24+ hours notice is provided.

7. Assumption of Risk & Warning under the Civil Liability Act 2002 (NSW)

Rugby, and the coaching, drills, conditioning and skill work provided through NINEBASE (whether online or in-person), are 'dangerous recreational activities' within the meaning of the Civil Liability Act 2002 (NSW). Participation involves an inherent and obvious risk of physical injury, including but not limited to sprains, strains, fractures, concussion, spinal injury, permanent disability or, in rare cases, death. By using the Services you (and, if you are under 18, your parent or guardian on your behalf) acknowledge, accept and voluntarily assume all such risks.

8. Release, Waiver & Indemnity

To the maximum extent permitted by law, you release Harrison Goddard, NINEBASE, its contractors, coaches, venue providers and affiliates (the 'Released Parties') from any and all claims, demands, actions, liabilities, costs and expenses (including legal costs) arising out of or in connection with your participation in the Services, including any personal injury, death, illness, loss or damage to property, howsoever caused, including where caused by the negligence of a Released Party (except to the extent such release is prohibited by law). You agree to indemnify and keep indemnified the Released Parties against any claim brought by you or on your behalf arising from your participation.

9. Medical Fitness

You represent and warrant that you are medically fit to participate in strenuous physical training and rugby-specific drills. It is your responsibility (or your guardian's) to seek independent medical advice prior to commencing any program. You must disclose any relevant medical conditions, prior injuries or concussion history to Harrison before an in-person session. NINEBASE is not a medical or physiotherapy provider and nothing in the Services constitutes medical advice.

10. Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or limited. To the extent NINEBASE is entitled to limit its liability for a breach of a non-excludable consumer guarantee, its liability is limited (at its option) to the resupply of the Services or the payment of the cost of resupply.

11. Limitation of Liability

Subject to clause 10, to the maximum extent permitted by law: (a) the Released Parties are not liable for any indirect, incidental, consequential, special or punitive loss or damage; (b) the total aggregate liability of the Released Parties to you for any and all claims arising out of or in connection with the Services is limited to the total fees paid by you to NINEBASE in the three (3) months preceding the event giving rise to the claim.

12. Intellectual Property

All video, written, audio and coaching material provided through the Services is owned by Harrison Goddard / NINEBASE and is protected by copyright. You are granted a personal, non-exclusive, non-transferable, revocable licence to access the material for your own training use only. You must not copy, share, redistribute, publicly display, or use any material for commercial purposes without prior written consent.

13. Code of Conduct

You agree to conduct yourself respectfully toward Harrison, NINEBASE staff, other members and any venue you attend. Harassment, discrimination, unsafe behaviour or unauthorised recording of other participants will result in immediate termination without refund.

14. Photography & Media

In-person sessions may be photographed or filmed for coaching and marketing purposes. Where possible, faces of minors will be blurred. If you do not consent to being filmed, notify Harrison in writing before the session.

15. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

16. Changes to the Terms

NINEBASE may update these Terms from time to time. Material changes will be notified via the platform or by email. Continued use after changes take effect constitutes acceptance.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
